In order for our guests to use this villa safely and comfortably, and to maintain the public nature of the rental villa, we have established the following rules that are integrated with the accommodation agreement.
If you do not comply with these rules, the accommodation contract may be cancelled in accordance with Article 6 of the Accommodation Contract.

<Terms of Use>

【1】About the use of guest rooms

  1. In principle, it is prohibited to use or enter the facility beyond the number of people contracted, even for a short time.
  2. If it is discovered that the number of people used exceeds the number of people contracted without notice, we will charge for the excess usage. 3. If it is discovered that the number of people in excess of the contracted number exceeds the number of people in the rental villa without notice, and the number of people who use the villa exceeds 8, which is within the scope of the business license of this rental villa, the accommodation contract will be canceled and all users, including the guests who originally made the offer, will be asked to move out.
  3. In the case of [1] 3, the accommodation fee that has already been received will not be refunded.
  4. Minors are not allowed to stay without the permission of a guardian.
  5. The use of bonfires, BBQ stoves, and other fires and candles rented from the facility is prohibited.
  6. Smoking is not allowed outside of the terrace.
  7. Please do not bring smoked cigarette butts indoors as they may cause odors.
  8. The use of hair dye and bleach in the shower room and washbasin is strictly prohibited.
  9. It is prohibited to use incense other than equipment in the facility, and other items that leave a remarkably strong scent.
  10. If your child or dog damages the facility equipment, etc., even if it is not intentional, if we judge that the family does not supervise it, we may charge you for repairs.
  11. Use for purposes other than accommodation is strictly prohibited.
  12. Unauthorized use of photographs taken in the facility for commercial purposes is prohibited.
  13. It is prohibited to take home towels and equipment provided in the facility. We may claim the return of equipment or compensation for damages based on ownership.

[2] Please refrain from bringing in or acting in the villa that may disturb other guests.

  1. Bringing in the following items
    (a) Animals, birds, etc., excluding dogs
    (b) Stimulants, narcotics, and other drugs whose possession is prohibited by law
    (c) Gunpowder that ignites or is easily flammable, or chemicals that may cause harm to the body.
    (d) Firearms, swords and similar items without a permit
    (e) Items that are extremely large or heavy
    (f) Items that emit foul odors
    (g) Garbage generated outside of the use of this rental villa and items that interfere with hygiene
    (h) Other items that the villa prohibits from being brought into the guest room.
  2. Acts that cause disgust or inconvenience to a third party, such as noisy acts such as singing and high gin, dissipation of strange odors, etc.
  3. Acts that are offensive to public order and morals.
  4. Posting or distributing leaflets, leaflets, or other advertising materials in the guest room.
  5. Moving, processing, or taking out various equipment and items in the facility, and using them for purposes other than their original purpose.
  6. Entry into places other than those reserved for guests
  7. Requesting food and beverage delivery from facilities other than those permitted by the villa, on-site chefs, etc.
  8. Activities for the purpose of profit
  9. All other acts that interfere with the safety and hygiene of the rental villa

[3] If the key of the facility is lost or intentionally malfunctions, the full cost of replacing the key will be charged.

<Terms and Conditions of Accommodation>

Article 1 (Scope of Application)

  1. The Accommodation Contract and related contracts concluded by the Rental Villa with the Guest shall be in accordance with the provisions of these Terms and Conditions and the Rules of Use (hereinafter referred to as the "Rules of Use") integrated with these Terms and Conditions, and matters not stipulated in these Terms and Conditions shall be governed by laws and regulations or generally established customs.
  2. In the event that the villa has entered into a special contract to the extent that it does not violate laws and regulations and customs, the special contract shall take precedence notwithstanding the provisions of the preceding paragraph.

Article 2 (Application for Accommodation Contract)

  1. A person who intends to apply for an accommodation contract (accommodation reservation) for this rental villa shall notify the rental villa of the following matters in accordance with Article 6 of the Hotel Business Act, Article 4-2 of the Construction Regulations of the same Act, and the ordinance established by the prefecture where the rental villa is located.
    (1) Name of the Guest(s)
    (2) Date of accommodation and estimated time of arrival
    (3) Guest's contact information (address, mobile phone number, e-mail address)
    (4) Other matters deemed necessary by the villa
  2. If there is a change in the contents of the request made to the rental villa based on the preceding paragraph, please promptly notify the rental villa of the changed contents.
  3. In the event that the Guest requests to extend his/her stay beyond the date set forth in paragraph (2) of Paragraph 1 during his/her stay, the villa shall be deemed to have applied for a new accommodation contract at the time the request is made.

Article 3 (Conclusion of Accommodation Contract)

  1. The accommodation contract shall be concluded when the rental villa accepts the application set forth in the preceding article.
  2. When an accommodation contract has been concluded pursuant to the preceding paragraph, the accommodation fee for the entire period of stay pertaining to the accommodation contract shall be paid by credit card payment within 60 minutes at the time of reservation
  3. In the event of any of the following events, the Rental Villa shall treat the application as if the application was made to the customer despite the fact that the guest has no intention of actually staying at the hotel, and the accommodation contract shall lose its validity.
    (1) When the guest is unable to pay the accommodation charges set forth in the preceding paragraph by the date specified by the villa in accordance with the provisions of the same paragraph.
    (2) When the Guest is unable to contact the contact information requested pursuant to Paragraph 1 of the preceding Article within 10 days from the date of the first contact (provided, however, that if the number of days up to the date of accommodation is less than this, the contact information cannot be contacted until 3 p.m. on the day of the accommodation).
    (3) When the guest refuses to contact you from the villa. 4. In the event that (2) and (3) of the preceding paragraph apply, the received accommodation fee will not be refunded.

Article 4 (Refusal of Accommodation)

The villa may not accept the conclusion of an accommodation contract in the following cases.

  1. When the application for accommodation does not comply with these Terms and Conditions.
  2. When the room cannot be provided due to full occupancy.
  3. When there is a reason equivalent to the preceding paragraph, such as the fact that the guest room should be provided on a priority basis for the disaster victim and the person in charge of disaster recovery due to the occurrence of a disaster or other emergency.
  4. When the person seeking accommodation is a member of an organized crime group, an organization related to an organized crime group, or any other antisocial force as defined in the Act on Prevention of Unjust Acts by Organized Crime Group Members and the Prefectural Ordinance on the Elimination of Organized Crime Groups. When it is deemed that the person seeking accommodation is likely to conduct himself or herself in a manner that will contravene the provisions of laws and regulations, public order or good morals in regard to his/her accommodation;
  5. When the person seeking accommodation can be clearly recognized as suffering from an infectious disease;
  6. When the Hotel is requested to provide services or other burdens that exceed the socially accepted range of accommodation.
  7. When it is not possible to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable reasons.
  8. When the person seeking accommodation is intoxicated and is likely to cause trouble to neighboring residents, etc., or may interfere with the operation of the hotel, or when he or she behaves in a manner that causes inconvenience to other guests or employees of the villa.
  9. When the person seeking accommodation is in a state where mental or physical disorder is clearly recognized.
  10. When only minors without the permission of a parent or guardian are staying at the hotel.
  11. When an application for accommodation is made for the purpose of transferring the right to stay to another person.
  12. When you apply for accommodation even though you have no intention of staying at the hotel.
  13. When the person who intends to stay has a problem with the villa in the past, such as late payment of the price or use of the villa in a significantly soiled state.
  14. In addition, when it is possible to refuse accommodation stipulated by various laws and regulations or prefectural ordinances.

Article 5 (Guest's Right to Cancel Contract)

  1. The guest may cancel the accommodation contract by notifying the villa rental.
  2. In the event that the Guest cancels the entire Accommodation Contract in accordance with the preceding Paragraph, a cancellation fee shall be charged as follows:
    (1) 100% on the day
    (2) 50% the day before
    (3) 2 days to 10 days ago 40%
    (4) 11 days to 20 days 20%
    (5) Other than the above 0%
  3. In the event that the Guest does not arrive by the check-in time on the day of accommodation without contacting the guest, the villa may be treated as having been cancelled by the guest.

Article 6 (Right to Cancel Contract of the Rental Villa)

  1. The rental villa may cancel the accommodation contract in the following cases.
    (1) When the Guest is a member of an organized crime group, an organization related to an organized crime group, or any other antisocial force as defined in the Act on Prevention of Unjust Acts by Organized Crime Group Members and the Prefectural Ordinance on the Elimination of Organized Crime Groups.
    (2) When the Guest engages in or is likely to commit acts such as assault, intimidation, extortion, unreasonable demands, gambling, possession or use of drugs, firearms, swords or similar items not permitted by laws and regulations, acts that cause trouble to nearby residents or other guests, or other acts that are contrary to laws and regulations or public order and morals.
    (3) When the Guest can be clearly detected as being afflicted with an infectious disease;
    (4) When the Guest is requested to provide services or other burdens beyond a reasonable range in relation to the accommodation;
    (5) When it is not possible to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable reasons.
    (6) When the Guest engages in an act that interferes with fire prevention and prevention, such as smoking in bed in the guest room, mischief with firefighting equipment, etc.
    (7) When the right to stay is transferred or attempted to be transferred;
    (8) When the Guest fails to pay the usage fee to the Rental Villa, or when it is delayed.
    (9) When the Guest has made a false application at the time of concluding the Accommodation Contract;
    (10) When it is deemed that the guest is likely to cause trouble to nearby residents or other guests due to intoxication, etc.
    (11) In the event of a violation of these Terms and Conditions or the rules of use of the Hotel.
    (12) In addition, when it is possible to refuse accommodation stipulated by various laws and regulations or prefectural ordinances. Notice of termination pursuant to the preceding paragraph shall be given orally or by telephone, e-mail, or written to the contact information of the customer who has made a request pursuant to Article 2, and if such notice does not arrive even after notifying the contact information requested pursuant to Article 2, the provisions of Article 3, Paragraph 3 shall apply, and it shall be deemed to have arrived at the time when the period normally to be reached has elapsed. In the event that the rental villa cancels the accommodation contract in accordance with the provisions of the preceding paragraph, the accommodation fee will not be refunded.

Article 7 (Registration of Accommodation)

In accordance with Article 6 of the Ryokan Business Act, Article 4-2 of the Ordinance for Enforcement of the same Act, and the ordinances established by the prefecture where the villa is located, the guest is required to register the following matters in the facilities of the villa on the day of accommodation.

  1. Name, age, gender, address and occupation of the Guest;
  2. In the case of foreign nationals, nationality, passport number, port and date of entry into Japan;
  3. Departure date and estimated time of departure
  4. Other matters deemed necessary by the hotel.

Article 8 (Occupancy Hours of Guest Rooms)

  1. The time during which the Guest may use the facilities of the Rental Villa shall be from the check-in time specified by the Rental Villa to the check-out time. However, in the case where the Guest is accommodated consecutively, the Guest may occupy the room all day long, except for the days of arrival and departure.
  2. In principle, the use of facilities after the check-out time is prohibited in this rental villa.
  3. Even within the time when the guest can use the guest room in accordance with the preceding paragraph, the rental villa may enter the guest room and take necessary measures when it is necessary for safety and hygiene management or other operation and management of the villa.

Article 9 (Compliance with Rules of Use)

Guests are required to comply with the rules of use of the villa in the villa.

Article 10 (Payment of Fees)

  1. The breakdown of the accommodation charges, etc. to be paid by the guest shall be based on the price list posted on the website.
  2. Payment of the accommodation charges, etc. set forth in the preceding paragraph shall be made by credit card within 60 minutes at the time of reservation for the entire period of stay pertaining to the accommodation contract.
  3. For meal services contracted by the villa, such as on-site chefs and catering, payment will be made according to the fees and payment methods posted on the website. In addition, a penalty fee will be incurred at the time of cancellation for each meal service, and they will be paid to each contracted restaurant.
  4. When requested by the villa for local purchases other than accommodation charges and meal services, the villa will be settled at the villa facility by using Japan yen, a credit card approved by the villa, or a payment method approved by the villa. 5. Even if the guest does not voluntarily stay at the hotel after the villa has provided the guest room and made it available for use, the accommodation fee will be charged.

Article 11 (Responsibility of the Rental Villa)

  1. In the event that the Rental Villa causes damage to the Guest due to non-performance of the Accommodation Contract or related contracts, or due to tortious acts, the Rental Villa shall compensate the Guest for the damage up to a maximum of 100,000 yen, except in cases of willful misconduct or gross negligence on the part of the Rental Villa. However, this does not apply if it is due to reasons attributable to the rental villa.
  2. The villa is insured to deal with the damage described in the preceding paragraph by the customer, but the damage incurred by the customer may not be compensated if it falls under the exemption grounds under the insurance contract.

Article 12 (Handling when the contracted room cannot be provided)

  1. In the event that the Rental Villa is unable to provide the contracted room to the Guest, the Rental Villa shall, with the consent of the Guest, arrange other accommodation of the same standard as far as possible.
  2. In the event that the Rental Villa has made efforts to arrange other accommodations based on the preceding paragraph, but is unable to do so, the Rental Villa may cancel the Accommodation Contract. In this case, the provisions of Article 6, Paragraph 2 shall apply mutatis mutandis to the notification of cancellation. In addition, if there is a reason attributable to the villa for not being able to provide the guest room, the villa will pay the guest a compensation fee equal to double the amount of the contracted room, and the compensation fee will be used for damages.

Article 13 (Handling of Deposited Items, etc.)

  1. In the event of loss, breakage, or other damage to the goods or valuables entrusted to the guest, the villa shall compensate for the damage, except in cases of force majeure. However, for items that have not been notified in advance by the customer of the type and value, we will compensate for the damage up to 100,000 yen, except in cases of willful misconduct or gross negligence on the part of the rental villa.
  2. In the event of loss, breakage, or other damage caused by reasons attributable to the guest of the villa, the villa shall compensate the guest for the damage. However, in the case of items for which the customer has not clearly notified the type and value in advance, the damage will be compensated up to 50,000 yen, except in cases of willful misconduct or gross negligence on the part of the villa.

Article 14 (Storage of Customer's Baggage or Personal Belongings)

  1. In the event that the Guest's baggage arrives at the Vacation Home prior to his/her stay, the Guest's baggage shall be kept responsibly and handed over to the Guest at the time of check-in only if the Guest has been informed and agreed to the Guest's baggage prior to arrival.
  2. In the event that the guest's baggage or belongings are left behind in the villa after the guest has checked out, the guest will keep the baggage for a maximum of 7 days including the date of discovery, and then deliver it to the nearest police station. However, valuables shall be immediately delivered to the nearest police station. In addition, food, drinks, magazines, and other similar items will be disposed of at the villa if you do not contact us by the day after the check-out date.
  3. Items that are judged to require refrigeration or freezing storage, such as perishable foods in the preceding paragraph, will be disposed of at the rental villa immediately after check-out for hygiene management and cleaning.
  4. In order to properly dispose of the misplaced baggage or belongings in accordance with the nature of the contents, the Rental Villa may arbitrarily inspect the contents of the baggage or belongings, return it to the lost person or dispose of it in accordance with the preceding paragraph as necessary, and the guest shall not be able to raise any objection to this.
  5. The Hotel's liability for the custody of the Guest's baggage or belongings in the case of Paragraph 1 shall be compensated for damages up to a maximum of 10,000 yen, except in cases of willful misconduct or gross negligence on the part of the Rental Villa.

Article 15 (Responsibility of the Guest)

In the event that the Rental Villa incurs expenses for cleaning and repairing the guest rooms, loss of sales opportunities, or other damages due to acts by the Guest that violate these Terms and Conditions or the Rules of Use, or other reasons attributable to the Guest, the Guest shall compensate the Guest for the damages incurred by the Rental Villa.

Article 16 (Revision of Terms and Conditions)

These terms and conditions may be revised at any time as necessary. In the event that these terms and conditions are revised, the villa shall post the contents of the revised terms and conditions and the effective date on the website of the villa or in the guest room.
